Terms of Service

1. The service

QuickWA provides a WhatsApp Business messaging platform — a shared team inbox, broadcasts, templates, automation, contacts/CRM, analytics, calling and developer APIs — built on the official Meta WhatsApp Cloud API. Features may change, improve or be discontinued over time.

2. Eligibility & accounts

• You must be at least 18 and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your password secure.
• You are responsible for all activity under your account, including your team members.

3. Acceptable use

You agree NOT to use QuickWA to:

• Send spam, unsolicited bulk messages, or message contacts without valid opt-in.
• Send unlawful, fraudulent, deceptive, hateful, harassing, or infringing content.
• Violate the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy, or Meta Platform Terms.
• Attempt to breach security, reverse-engineer, scrape, or overload the platform.
• Resell or misrepresent the service, or impersonate others.

Violations may lead to suspension or termination and may be reported to Meta.

4. WhatsApp / Meta compliance

Your use of WhatsApp through QuickWA is also subject to Meta’s and WhatsApp’s terms and policies. You are responsible for obtaining proper opt-in, respecting opt-outs, using approved message templates, and complying with all applicable laws (including telemarketing and data-protection laws).

5. Billing & subscriptions

• Paid plans are billed in advance on a recurring basis through our payment partner (e.g. Razorpay).
• Plan limits (agents, contacts, messages) apply per your selected plan.
• WhatsApp conversation charges levied by Meta are separate and billed by Meta to your WhatsApp account.

6. Your data

You retain ownership of your contacts and message content. You grant QuickWA the limited rights needed to operate the service for you. Our handling of data is described in our Privacy Policy.

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. The platform is provided “as is” and “as available”. We are not liable for outages, delays, or message failures caused by Meta/WhatsApp, carriers, or factors outside our control.

8. Termination

You may stop using and delete your account at any time. We may suspend or terminate accounts that violate these Terms or applicable policies. On termination, your right to use the service ends and we delete data as described in the Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by law, QuickWA is not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

10. Changes to these Terms

We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts at Jaipur, Rajasthan shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of QuickWA, without regard to conflict-of-law rules.
